1. Description of Service These Terms of Service are applicable to all users of the online media and content distribution services provided by Good Practice Yoga, LLC (the “Company”). These Terms govern your use of the Services, including all video streaming, audio, visual, written media, and user interfaces provided by the Company.
2. Acceptance and Changes to Terms The Company shall have the right to modify, add, or remove any terms of this Agreement at any time. Any changes shall be effective immediately upon posting. Your continued use of the Services following changes shall constitute your acceptance of those changes.
3. Access, Use, and Maturity Warning Users accessing the Services must be at least thirteen (13) years of age. Users registering for a membership must be at least eighteen (18) years of age. CONTENT WARNING: The Services provide "unplugged" content which may contain PG-13 themes and adult language. Minors between the ages of 13 and 18 must have the explicit permission and supervision of a parent or guardian to access the Services. The Company makes no claims that the Services may be lawfully accessed in any specific location; you are solely responsible for compliance with your local laws.
4. Your Conduct The Services may be used only for lawful purposes. You are prohibited from attempting to violate the security of the Services, scraping data, or interfering with other users. In community forums, you agree to treat everyone with respect. Bullying, harassment, or degrading comments regarding race, religion, culture, sexual orientation, gender, or identity will result in immediate account suspension or removal.
5. User Information You are solely responsible for the information you input. The Company reserves the right to decide whether user-generated content is appropriate. Your privacy rights are set forth in our Privacy Policy.
6. Username/Password/Security You are responsible for maintaining the confidentiality of your login information and are responsible for all uses of your account, whether authorized by you or not.
7. Use of Services, Medical Disclaimer, and Safety The Company grants you a limited, non-exclusive license for personal, non-commercial use. IMPORTANT MEDICAL NOTICE: GOOD PRACTICE YOGA, LLC IS NOT A MEDICAL ORGANIZATION. THE CONTENT PROVIDED IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. YOU MUST CONSULT WITH A PHYSICIAN OR HEALTHCARE PROFESSIONAL BEFORE STARTING ANY MOVEMENT OR EXERCISE PROGRAM. YOU ARE PARTICIPATING AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR PHYSICAL ENVIRONMENT IS SAFE AND CLEAR OF HAZARDS (E.G., FURNITURE, PETS, SLIPPERY FLOORS) BEFORE BEGINNING ANY PRACTICE. GOOD PRACTICE YOGA, LLC IS NOT RESPONSIBLE FOR INJURIES RESULTING FROM YOUR ENVIRONMENT OR EQUIPMENT. IF YOU FEEL PAIN OR DIZZINESS, YOU MUST STOP IMMEDIATELY.
8. Access to Services – Subscriptions & Purchases The Company grants you a limited right to view video streams based on your selected payment plan. The Company makes no guarantees regarding stream resolution, which depends on your hardware and internet connection.
9. Payments, Billing, and Refund Policy By purchasing a plan, you authorize the Company to charge your designated Payment Method. REFUND POLICY: ACCIDENTAL RENEWALS HAPPEN. IF YOU DID NOT MEAN TO RENEW, YOU MUST NOTIFY THE COMPANY WITHIN THREE (3) DAYS OF THE RENEWAL DATE TO BE ELIGIBLE FOR A REFUND. AFTER THIS 3-DAY WINDOW, OR ONCE THE SERVICES HAVE BEEN USED OR STREAMED FOR THE NEW PERIOD, NO REFUNDS WILL BE ISSUED.
10. User Comments and Suggestions Any creative ideas or suggestions submitted to the Company become the exclusive property of Good Practice Yoga, LLC without compensation to the user.
11. Intellectual Property All programs, text, graphics, and interface layouts are the exclusive property of Good Practice Yoga, LLC and are protected by copyright and trademark laws. You may not modify, reproduce, or distribute the content for any purpose.
12. Social Networking Users may share links via third-party social networks at their own responsibility and must comply with those networks' terms.
13. Use of Software The Company grants a limited, non-transferable license to use any provided apps or software. You shall not reverse engineer, decompile, or disassemble the software.
14. Copyright Infringement If you believe your work has been infringed, please notify the Company’s designated agent with a signed statement and description of the work in question.
15. WARRANTY DISCLAIMERS THE SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. GOOD PRACTICE YOGA, LLC HEREBY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE COMPANY MAKES NO GUARANTEES CONCERNING SPECIFIC PHYSICAL OR MENTAL RESULTS FROM THE USE OF THE SERVICES. INDIVIDUAL RESULTS WILL VARY BASED ON EFFORT, CONSISTENCY, AND PRE-EXISTING PHYSICAL CONDITIONS.
16. LIMITATION OF LIABILITIES TO THE FULLEST EXTENT PERMITTED BY LAW, GOOD PRACTICE YOGA, LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, OR AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, BODILY INJURY, PHYSICAL HARM, EMOTIONAL DISTRESS, OR HEALTH COMPLICATIONS RESULTING FROM YOUR USE OF THE SERVICES. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE COMPANY’S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, REGARDLESS OF THE CAUSE OF ACTION, WILL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE SERVICES IN THE SIX MONTHS PRECEDING THE CLAIM.
17. INDEMNIFICATION YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS GOOD PRACTICE YOGA, LLC FROM AND AGAINST ANY LOSS, LIABILITY, CLAIM, ACTION, OR DEMAND, INCLUDING WITHOUT LIMITATION REASONABLE LEGAL AND ACCOUNTING FEES, RESULTING FROM (I) YOUR USE OF THE SERVICES; (II) YOUR BREACH OF THESE TERMS; OR (III) ANY INJURY OR DAMAGE CAUSED BY YOUR PARTICIPATION IN THE SERVICES OR YOUR PHYSICAL ENVIRONMENT.
18. Communications By using the Services, you consent to receive electronic communications from the Company regarding your account and marketing updates.
19. Additional Terms and Conditions This Agreement shall be governed by the laws of the state where Good Practice Yoga, LLC is registered. If any provision is held invalid, the remaining provisions remain in full effect. You may not assign your rights under these Terms to any other party.
